CHARGE: Conspiracy to Distribute Marijuana. Los Angeles District Attorney Major Narcotics Unit charged client with conspiracy to distribute over 1000 kg of marijuana.
RESULT: Case dismissed prior to preliminary hearing.

CHARGE: Lewd Act on a Minor
RESULT: After we conducted extensive investigation and intervened with LAPD and the District Attorney’s Office, no charges were filed.

CHARGE: Felony Domestic Violence
RESULT: After intensive defense investigation, case dismissed, client found factually innocent. Police filed charges on alleged “victim” for filing a false police report.

RESULT: After proactive early intervention and presentation of evidence to Santa Monica Police Department, District Attorney and Santa Monica City Attorney, no charges filed.

CHARGE: Felony Negligent Discharge of a Firearm
RESULT: Reduced to misdemeanor Los Angeles municipal code violating for discharging a firearm without a permit. No jail time, no community labor, no community service.

Los Angeles Superior Court, Burbank Courthouse

CHARGE: Pimping and Pandering. Charge calls for mandatory state prison.
RESULT: After extensive investigation, charge reduced to misdemeanor “assisting a prostitute.” Case dismissed altogether after performing minimal community service.

Los Angeles Superior Court, Long Beach Courthouse

CHARGE: Pimping and Pandering
RESULT: Although the California Penal code requires mandatory state prison on these charges, a negotiated agreement with prosecution allowed to client to be placed on diversion and eligible to withdraw no contest plea after successful completion of short-term probation.  Client not only avoided prison, but will avoid a felony conviction altogether.

United States District Court, Central District of California

CHARGE: Money laundering, tax fraud, wire fraud, mail fraud investigation
RESULT: Client targeted by the government in multi-jurisdiction fraud investigation. After extensive negotiations and counter-investigation, client was not indicted.

United States District Court, Central District of California

CHARGE: Distribution and conspiracy to distribute over 2000kg of marijuana.
RESULT: Client faced 10 year mandatory minimum. Thorough and intensive negotiations lead to reduction in charge and sentence. Client sentenced to 7 months (time served). All fines waived.

United States District Court, District of Massachusetts

CHARGE: Wire Fraud. Alleged loss of $5 million.
RESULT: Client initially facing 97-121 months (GSR of 20) in prison. Client eventually sentenced to 8 months in custody, all fines waived.

United States District Court, Central District of California

CHARGE: Transporting of a destructive device on a commercial aircraft.
RESULT: Client faced up to 5 years in prison. Charge reduced to one count of making a false statement to federal law enforcement agent and sentenced to probation.

Los Angeles Superior Court, Airport Courthouse

CHARGE: Sale of Marijuana, Possession for Sale of Marijuana

RESULT: After negotiations with District Attorney, charge reduced to simple possession of concentrated cannabis (hash), client was given a Deferred Entry of Judgment. After the completion of a drug awareness program, the charge will be dismissed.

Los Angeles Superior Court, Airport Courthouse

CHARGE:  Assault With a Deadly Weapon, Criminal Threats, two counts of Vandalism.  All filed as felonies, including one strike.

RESULT:  After our extensive investigation into the circumstances surrounding the allegations, charges reduced to one misdemeanor count and no jail time.  Client required to complete short stint of community service and anger management classes.

Los Angeles Superior Court, San Fernando Courthouse

CHARGE:  Robbery.

RESULT:  Case Dismissed At Preliminary Hearing. After conducting a thorough investigation and witness interviews and presenting this information at the preliminary hearing, the prosecution was unable to present sufficient evidence to proceed to the trial court.

Los Angeles Superior Court, Airport Courthouse

CHARGE: Felony Domestic Violence. Over an eight week period, client was arrested four times for felony domestic violence.

RESULT: No charges filed. After presenting the District Attorney with the results of our thorough  investigation of the facts and circumstances of each arrest, along with a plan of substance abuse treatment and psychological counseling, no charges were filed.
Los Angeles Superior Court, Santa Clarita Courthouse

CHARGE:  DUI with property damage.  Felony Child Endangerment. Client arrested for these charges after falling asleep while driving.

RESULT:  No charges filed. Early intervention with police and prosecution resulted in no case filing.  An extensive investigation by our office convinced law enforcement not to file a case.

Los Angeles Superior Court, Beverly Hills Courthouse

CHARGE:  Domestic Violence, Theft. Client charged with battering and injuring victim and stealing her personal property. Incident occurred in front of the Beverly Hills police station with numerous witnesses.  Client faced significant jail time.

RESULT:  Negotiated down to lesser misdemeanor with no theft conviction and no jail time. Client perform 10 days of community service and anger management.

Los Angeles Superior Court, Airport Courthouse

CHARGE: DUI. Accident with Property Damage. Driver accused of jumping curb and knocking over parking meter.
RESULT: No charges filed. No license suspension. Early intervention with police and prosecutor showing errors in arrest procedure and blood testing resulted in no case being filed.

Los Angeles Superior Court, Long Beach Courthouse

CHARGE:  Felony failure to register as a sex offender. Client failed to register as convicted sex offender for over 2 years, was also convicted of failure to register in 2005, client apprehended out of state and extradited to California.  DA offered 4 years in prison. As this was technically a “third strike”, client was not eligible for half time and would have done 85% of the four years followed by parole.

RESULT: Sentenced to 3 years probation and 60 days of community labor (Cal Trans). No jail. No prison.

CHARGE: Grand theft and elder abuse – over $600,000 in cash and propertyClient accused of stealing over $600,000 worth of cash and property from elderly man (including the man’s house). Overwhelming paper trail implicating client in scheme. Client facing lengthy state prison term.
RESULT: Probation. No prison. No jail.

Los Angeles Superior Court, Lancaster Courthouse

CHARGE: Cultivation of Marijuana and Possession of Marijuana For Sale. Client operating grow house, not a U.S. Citizen.

RESULT: Informal Diversion, no conviction entered. If client does not pick up any new cases (not arrested) again in one year, case will be dismissed.  No risk of removal from United States due to this case.

Los Angeles Superior Court, Pasadena Courthouse

CHARGE:Attempted Murder (3 counts), Arson (1 count). Client accused of attempting to kill occupants of home by burning it down while they slept inside.

RESULT: Hung jury 10-2 (10 voting in favor of “not guilty”). Charges Dismissed.

Los Angeles Superior Court, Airport Courthouse

CHARGE: Possession for Sale of Marijuana. Charge dismissed and 37lb of marijuana returned to a patient’s collective after raising a medical marijuana defense.
RESULT: Possession for sale of  90 plants and 51 ½ lbs of dried marijuana. Case dismissed on medcial marijuana defense.  All marijuana returned to client.

Los Angeles Superior Court, San Fernando Courthouse

CHARGE: Possession for sale and cultivation of marijuana.

RESULT: Case dismissed after raising medical marijuana defense at preliminary hearing.

Los Angeles Superior Court, Lancaster Courthouse

CHARGEPossession for sale and cultivation. Evidence included 11 lbs of marijuana and $8,000.

RESULT: No jail or prison time. Charges to be dismissed after successful completion of probation.

Los Angeles Superior Court, Van Nuys

CHARGE: Possession for Sale  and Transportation of marijuana and two pounds of hash, plus possession of a switchblade.

RESULT: No jail or prison time. Plead to straight possession of hash. Charges to be dismissed after successful completion of probation.

Los Angeles Superior Court, Metropolitan Courthouse

CHARGE:  DUI – BAC .16% at time of driving.

RESULT:  Reduced to a “Speed Exhibition” a non-alcohol related traffic violation.

Los Angeles Superior Court, Airport Courthouse

CHARGE: Selling Unregistered Motor Vehicles, Operating as Unlicensed Automobile Dealer.
RESULT: Plead to minor “disturbing the peace” misdemeanor. No jail time.  No Community Service.  No Community Labor.  $100 fine and 1 year informal probation.  Eligible for dismissal after one year

Los Angeles Superior Court, Compton Courthouse

CHARGE: Bringing a Weapon into a Courthouse (Felony).
RESULT: No jail time.  Client will go undergo six months of weekly counseling and case will be dismissed.

Los Angeles Superior Court, Criminal Courts Building

CHARGE: Prostitution. Client accused of posting prostitution ad on Craig’s List with her photo and agreeing to sex for money with undercover officer who responded to ad. Three police officers testified against client and Craig’s List ad used against client at trial.

RESULT: Charges Dismissed At Trial.

Los Angeles Superior Court, Criminal Courts Building

CHARGE: Felony Insurance Fraud. Alleged loss of $250,000. Business owners charged with reporting false payroll records to California Worker’s Compensation Board.

RESULT: Restitution only. No jail time, no probation. “Corporate Plea”, individuals did not enter a guilty plea and still have no criminal record.

CHARGE: Felony Possession of Cocaine for Sale. Two undercover police officers were prepared to testify at trial against client who was caught in sting operation.

RESULT: Deferred Entry of Judgment and Dismissal.

Los Angeles Superior Court, San Fernando Courthouse

CHARGE: Felony Possession of  Amphetamine for Sale

RESULT: Negotiated reduction to straight possession, client will complete Deferred Entry of Judgment program (drug classes) and charge will be dismissed.

Imperial County Superior Court, El Centro

CHARGE: 3 counts of Conspiracy to transport heroin into a state prison. Client Faced 4 years in state prison.

RESULT: Negotiated down to a “wobbler” offense, client will perform 90 days of community service. After completion, client is eligible to have charge reduced to misdemeanor and dismissed.

Los Angeles Superior Court, Bellflower/Norwalk Courthouse

CHARGE: Felony Domestic Violence. Incident occurred in courthouse parking lot, sheriff’s deputies and court staff witnessed client striking alleged victim.
RESULT: Dismissed after announcing “ready for trial.”

Los Angeles Superior Court, Airport Courthouse

CHARGE: Felony Petty Theft (with multiple Priors), Commercial Burglary, Felony Evading of Police.
RESULT: No jail or prison. Probation, Community Service and attendance at Shoplifters Anonymous Meetings.

California Superior Court, Ventura

CHARGE: Cultivation of marijuana. Police raided 100+ plant growing operation in his residence. Client not a qualified medical marijuana patient.
RESULT: Dismissed after raising medical marijuana defense.

Los Angeles Superior Court, Downey Courthouse

CHARGE: DUI with Refusal. Resisting Arrest. Client accused of DUI, forcibly resisting arrest, trying to fight police, and refusing a mandatory blood alcohol test. Client faced jail time and one year loss of driver’s license.

RESULT: No charges filed.

Los Angeles Superior Court, Metropolitan Courthouse

CHARGE: Third DUI in 3 years. Client had BAC of .13, fought with police during arrest, and repeatedly admitted to being under influence of both alcohol and narcotics.

RESULT: Probation. No jail time.

Los Angeles Superior Court, Criminal Courts Building

CHARGE:  One count of Assault With a Deadly Weapon and One count of Battery with Great Bodily Injury. Incriminating 911 calls consistent with numerous eyewitness statements.
RESULT: Informal diversion and Dismissed.

Los Angeles Superior Court, Van Nuys Courthouse

CHARGE: Felon in possession of a Firearm and Two Probation Violations. Police found two firearms in client’s home Facing state prison time.

RESULT: Reduced to a minor “disorderly conduct” misdemeanor. No jail time. No community service. No fines or fees. Probation reinstated. Eligible for expungement after completion of probation.

Kern County Superior Court, Delano

CHARGE: Smuggling narcotics into a state prison (four felony counts). Client caught on video transferring narcotics to a prison inmate. Client also confessed to authorities (also on video). Facing mandatory state prison time.

RESULT: Probation and eligible to have charge reduced to misdemeanor and expunged from record in one year.

San Bernardino Superior Court, Rancho Cucamonga Courthouse

CHARGE: Grand Theft By Embezzlement. Credit Card Fraud. Charged as Felony. Manager of major retail chain caught repeatedly stealing thousands of dollars worth of cash and merchandise. Incriminating video evidence and computer records.
RESULT: Reduced to Misdemeanor. No jail time. Community service and probation. After probation, conviction can be set aside (“expunged”).

Recent examples of results of Mr. Gunsberg’s work in Los Angeles County juvenile courts include:

  • No charges filed against minor charged with sexual assault against high school classmate. Minor not expelled from school.
  • Case dismissed against minor charged with sexual assault of middle school classmate. Minor not expelled from school.
  • Attempted murder charge and all gang allegations dismissed against 16-year-old alleged to have been involved in gang-related drive-by shooting. Case kept in juvenile court.
  • Involuntary manslaughter case dismissed against high school student accused of causing heroin overdose of another teen.
  • Case dismissed against minor accused of sexual assault on a neighbor.
  • Case dismissed against minor accused of selling marijuana at school. Minor not expelled from school.
  • Case dismissed against minor accused of battery with great bodily injury at school. Minor not expelled from school.
  • Case dismissed against minor accused of possessing a weapon at school. Minor not expelled from school.
  • Case dismissed against minor accused of sexual assault on a family member.
  • No charges filed against minor accused of identity theft.
  • No charges filed against minor accused of unlawfully possessing a firearm.
  • Charges reduced to infraction for minor accused of DUI.
  • In a gang-related kidnapping case, client remained in juvenile court despite efforts to transfer case to adult court. Client will be eligible to earn dismissal.
  • Successful reduction of charge and opportunity to earn dismissal for 16-year-old client facing robbery charge which would have resulted in an adult strike.
